General Terms and Conditions
Last updated: October 2026
These Terms and Conditions apply to the use of SoloCompass.
1. Contracting Party and Scope
These Terms and Conditions (“Terms”) govern the use of SoloCompass, a digital service operated by:
Alina Bayer, founder of AviaSpark e.U.
Sole proprietor under Austrian law
AviaSpark e.U.
Linzer Straße 17
4100 Ottensheim
Austria
Email: [email protected]
Hereinafter referred to as the “Provider”.
Purchases made through Creem are processed through Creem as merchant of record and contractual reseller. The purchase transaction is therefore also subject to Creem’s Buyer Terms. These Terms describe the SoloCompass service and its use and apply alongside Creem’s Buyer Terms. If the documents conflict on the purchase transaction, payment, invoicing or Creem’s services, Creem’s Buyer Terms take precedence to the extent stated in those terms. Mandatory rights under applicable law remain unaffected.
1.1. SoloCompass is operated by the Provider and is designed primarily for solo professionals and people who manage work independently.
1.2. These Terms apply to customers who purchase or use SoloCompass as consumers and to customers who purchase or use SoloCompass in the course of their business or professional activity.
1.3. Mandatory consumer protection provisions remain unaffected by these Terms. In particular, statutory rights under the Austrian Consumer Protection Act (KSchG), the Distance and Off-Premises Contracts Act (FAGG), the Consumer Warranty Act (VGG) and other applicable mandatory legislation remain unaffected.
2. SoloCompass Service
2.1. SoloCompass is a web-based digital service designed to help users organize and manage the work involved in running a one-person business or independent professional practice.
2.2. The features available to the customer are those stated for the selected subscription plan at the time the contract is concluded, subject to statutory rights concerning conformity and updates.
2.3. The features and functionality available through SoloCompass may change over time as the service is developed. Changes may include improvements, additions, modifications or removal of individual features, provided that applicable mandatory legal rights remain unaffected.
2.4. SoloCompass is a productivity and business-organization tool. It does not constitute legal, tax, accounting, financial, medical or other professional advice.
3. Account and Access
3.1. Use of SoloCompass requires the creation of a user account.
3.2. Customers are responsible for providing accurate information and keeping their account credentials confidential. Customers must notify the Provider without undue delay if they become aware of unauthorized access to their account.
3.3. An account may not be shared with other individuals unless the applicable SoloCompass plan expressly permits this.
4. Customer Status
4.1. SoloCompass may be purchased by consumers and by customers acting in the course of their business or professional activity.
4.2. At checkout, customers may be asked to indicate whether they are purchasing as a consumer or as a business customer. This information helps determine which contractual and legal provisions apply.
4.3. The legal rights applicable to a customer are determined by the customer's actual legal status and applicable law. A customer cannot waive mandatory consumer protection rights merely by selecting a different status at checkout.
5. Contract Formation
5.1. The presentation of SoloCompass and its plans on the website does not itself constitute a binding offer. It constitutes an invitation to submit an offer unless expressly stated otherwise.
5.2. By completing checkout, the customer submits an order for the selected SoloCompass plan and agrees to these product-specific Terms. The purchase transaction is completed through Creem, which acts as merchant of record and contractual reseller. For a subscription that includes a free trial, the subscription arrangement is established at signup; the first subscription payment is not due until the trial ends, unless the customer cancels beforehand.
5.3. The customer will receive electronic confirmation and purchase information. Creem issues the payment confirmation and invoice for transactions processed through its service.
6. Free Trial
6.1. SoloCompass is initially offered with a fourteen-day free trial for the monthly and yearly subscription plans, subject to the terms displayed at checkout.
6.2. Access to SoloCompass begins after successful completion of the checkout process. The customer must provide the payment details required by the checkout process to start the trial.
6.3. Unless the customer cancels before the end of the fourteen-day trial period, the trial automatically converts into the paid subscription selected at checkout. The subscription price and billing interval are those clearly displayed for the selected plan immediately before the customer places the order and confirmed in the order confirmation. Applicable taxes are calculated and displayed by Creem at checkout as required by the customer’s location and status. The first payment is due when the trial ends.
6.4. Before checkout is completed, the customer will be informed of the trial duration, selected plan, subscription price, billing interval, automatic conversion and the timing of the first payment. The Provider may also send an email reminder before the trial ends, informing the customer that the free trial is due to end and that the selected subscription will convert to a paid subscription. The reminder does not replace the information provided at checkout or change the disclosed billing terms. Any additional notice required by mandatory law will also be provided.
6.5. Cancellation during the trial prevents conversion to the paid subscription and prevents the first subscription charge. Access to SoloCompass ends immediately when the cancellation takes effect.
6.6. The SoloCompass subscription contract is concluded when the customer completes signup through the app. The fourteen-day free trial and the statutory fourteen-day withdrawal period for eligible consumers are intended to run concurrently from the conclusion of the contract. Accordingly, the statutory withdrawal period will ordinarily expire at the end of the free trial, provided that the applicable statutory requirements have been met and no legal extension or exception applies. The free trial does not waive or replace the consumer's statutory withdrawal rights.
7. Subscription Plans and Prices
7.1. SoloCompass may be offered on a monthly plan and a yearly plan. The available plans, features, subscription price and billing interval are shown on the pricing page and again in checkout.
7.2. The price applicable to a customer’s initial subscription is the price clearly displayed for the selected plan immediately before the order is placed and stated in the order confirmation. The checkout will display the total amount payable, including applicable taxes for consumers and any applicable tax treatment for business customers, as required by law. Creem calculates and collects applicable indirect taxes in its role as merchant of record.
7.3. Prices for new subscriptions may change from time to time. A price change will not change the price of an existing subscription unless the change is permitted by the contract and applicable law and any required notice or consent has been provided. Any price change for an existing subscription will be communicated in advance where required by law.
7.4. Additional plans or features may be introduced in the future. Available payment methods are displayed during checkout.
8. Automatic Renewal
8.1. Unless cancelled before the end of the trial, the monthly plan converts to a paid subscription and renews automatically for successive monthly billing periods unless cancelled.
8.2. Unless cancelled before the end of the trial, the yearly plan converts to a paid subscription and renews automatically for successive twelve-month billing periods unless cancelled.
8.3. The price applicable to each billing period, billing interval, automatic conversion and renewal terms will be displayed before the customer completes the purchase and included in the order confirmation.
8.4. The Provider may send an email reminder before the free trial ends as described in Section 6.4. The Provider may also provide any further reminder or notice concerning automatic renewal or cancellation that is required by mandatory law.
9. Cancellation of a Subscription
9.1. Customers can manage and cancel their SoloCompass subscription at any time through Manage subscription in the sidebar menu of the SoloCompass app. Cancellation takes effect according to the rules set out in this section.
9.2. If the customer cancels during the free trial, cancellation prevents the first payment and access ends immediately.
9.3. If the customer cancels after the paid subscription has started, ordinary cancellation prevents the next renewal. Access remains available until the end of the current paid billing period, unless a statutory right or another mandatory legal provision requires otherwise.
9.4. The Provider does not offer voluntary or discretionary refunds for ordinary subscription cancellations. Cancelling a subscription does not, by itself, entitle the customer to a refund for a billing period that has already begun. This does not limit any refund, repayment or other remedy that mandatory law requires.
9.5. Cancellation does not affect amounts already due or other rights and obligations that arose before cancellation takes effect.
9.6. Ordinary subscription cancellation is separate from the statutory right of withdrawal available to eligible consumers under applicable law. Mandatory statutory rights remain unaffected.
10. Consumer Withdrawal Rights (B2C)
10.1. Eligible consumers may have a statutory right to withdraw from a distance contract under applicable consumer protection law. Where the Austrian Distance and Off-Premises Contracts Act (FAGG) applies, the withdrawal period for a service contract is generally fourteen days from the day the contract is concluded.
10.2. The SoloCompass subscription contract is concluded when the customer completes signup through the app. The statutory fourteen-day withdrawal period and the fourteen-day free trial are intended to run concurrently. Accordingly, consumers must exercise their statutory withdrawal right within the applicable withdrawal period, which will ordinarily end with the free trial, subject to mandatory law and any applicable extension of the statutory period.
10.3. Customers can manage and cancel their SoloCompass subscription at any time through Manage subscription in the sidebar menu of the app. Ordinary subscription cancellation and statutory withdrawal are distinct legal actions. Where required by law, a separate statutory withdrawal function will be made available through the online interface.
10.4. Cancellation during the free trial prevents the subscription from converting into a paid subscription and ends access immediately. A valid exercise of the statutory right of withdrawal has the legal consequences prescribed by applicable law.
10.5. The Provider will provide the statutory withdrawal information, model withdrawal form and any online withdrawal functionality required by applicable law. Nothing in these Terms excludes or limits mandatory consumer rights, including any applicable withdrawal or repayment rights.
11. Payments and Creem
11.1. Creem acts as the merchant of record and contractual reseller for purchases made through its checkout. Under Creem’s published Buyer Terms, the purchase transaction is between Creem and the customer, while the Provider remains responsible for delivering and supporting SoloCompass and for complying with the legal requirements applicable to the service. See Creem’s Buyer Terms.
11.2. Creem processes payments, issues invoices and calculates, collects and remits applicable VAT, sales tax or other indirect taxes in accordance with applicable law. The exact amount payable and applicable tax treatment are displayed in checkout before the order is completed.
11.3. Subscription management, payment-method updates and cancellation may be available through the Creem Customer Portal and/or the SoloCompass account interface, as indicated to the customer. Closing a Creem portal account alone does not necessarily cancel a subscription; the customer must use the available subscription-cancellation function.
11.4. Payment details are collected through Creem’s checkout infrastructure. The Provider does not intend to store full payment-card details directly, except where expressly disclosed and lawfully handled.
12. Refunds
12.1. The Provider does not offer voluntary or discretionary refunds. In particular, ordinary cancellation after a paid billing period has started does not entitle the customer to a refund for the unused remainder of that billing period.
12.2. Section 12.1 does not exclude, restrict or waive any refund, repayment, price reduction, withdrawal remedy or other remedy that is required by mandatory applicable law. If a consumer validly exercises a statutory withdrawal right and a repayment is due, the legally required repayment will be made in accordance with applicable law.
12.3. Refund requests relating to a purchase processed through Creem may be handled through Creem’s customer support or customer portal in accordance with Creem’s procedures, without affecting any statutory rights or the Provider’s obligations under applicable law.
13. Service Availability
13.1. The Provider aims to keep SoloCompass available and functioning reliably but cannot guarantee uninterrupted or error-free availability at all times.
13.2. Temporary interruptions may occur due to maintenance, updates, technical failures, security incidents, infrastructure problems or circumstances outside the Provider's reasonable control.
13.3. Mandatory statutory rights concerning the conformity and functionality of digital services remain unaffected.
14. Updates and Changes to the Service
14.1. SoloCompass is an evolving digital service. The Provider may improve, update or modify the service as it develops.
14.2. New features may be added from time to time.
14.3. Individual features may be modified or discontinued where there is a valid reason, including technical development, security requirements, legal requirements, changes in third-party services or changes to the Provider's business model, subject to applicable law.
14.4. Where applicable law requires advance notice, consent or another specific procedure for a material contractual change, the Provider will follow the applicable legal requirements.
15. Permitted Use
15.1. Customers may use SoloCompass only for lawful purposes and in accordance with these Terms.
15.2. Customers must not:
- use SoloCompass for unlawful purposes;
- attempt to gain unauthorized access to SoloCompass or another user's account;
- interfere with the security, availability or operation of the service;
- introduce malicious code or other harmful material;
- copy, reproduce, resell or commercially exploit SoloCompass itself without permission; or
- use SoloCompass in a way that infringes the rights of the Provider or third parties.
15.3. Each customer may use the free trial only once. Customers must not create or use additional accounts, identities or other arrangements to obtain repeated free trials or to avoid paying the applicable subscription fees. The Provider may take reasonable and lawful measures to detect and prevent repeated or abusive trial use, including restricting eligibility for further trials. This provision does not prevent customers from creating an account or purchasing a subscription where otherwise permitted.
15.4. The Provider may take reasonable security measures where necessary to protect the service or its users. Any restriction of access will be proportionate to the relevant risk and will not affect mandatory statutory rights.
16. Customer Content and Data
16.1. Customers may enter information, notes, tasks, project information and other content into SoloCompass (“Customer Content”).
16.2. Customers retain their rights in their Customer Content.
16.3. Customers are responsible for ensuring that they have the necessary rights and permissions to enter Customer Content into SoloCompass.
16.4. The Provider processes personal data in connection with SoloCompass as described in the Privacy Policy.
17. Data Protection
17.1. The Provider processes personal data in accordance with the GDPR, the Austrian Data Protection Act (DSG) and other applicable data protection legislation.
17.2. Details concerning the processing of personal data are set out in the Provider's Privacy Policy.
17.3. Where the service uses cookies, tracking technologies or comparable technologies, the applicable consent and information requirements will be observed.
18. Intellectual Property
18.1. SoloCompass, including its software, source code, design, interface, branding, text, graphics, trademarks, documentation, functionality and underlying systems, is owned by or licensed to the Provider and is protected by applicable intellectual property laws.
18.2. Except for the rights expressly granted to customers under these Terms, no intellectual property rights in SoloCompass are transferred to the customer.
18.3. Customers receive a limited, non-exclusive, non-transferable right to use SoloCompass for the duration of their active subscription in accordance with these Terms.
18.4. Nothing in these Terms transfers ownership of the Provider's intellectual property to customers.
19. Customer Feedback
19.1. Customers may voluntarily provide feedback, suggestions, survey responses or other comments concerning SoloCompass.
19.2. The Provider may use such feedback to understand customer needs and improve SoloCompass, its resources and related products, subject to applicable data protection and other legal requirements.
19.3. Separate permission will be obtained where the Provider intends to publish identifiable customer feedback as a testimonial.
20. Suspension and Termination
20.1. The Provider may restrict or suspend access where this is reasonably necessary to protect the service, its users or third parties, including in cases of serious or repeated violations of these Terms, unlawful use, security risks or non-payment.
20.2. Where required by applicable law, the customer will be given an opportunity to remedy a breach before termination.
20.3. Termination does not affect rights and obligations that by their nature are intended to survive termination.
21. Liability
21.1. The Provider is liable in accordance with applicable law.
21.2. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.
21.3. Mandatory consumer protection, warranty and statutory liability provisions remain unaffected.
21.4. To the extent permitted by law, the Provider is not responsible for indirect losses or consequences arising from the customer's use of the service that were not reasonably foreseeable at the time the contract was concluded.
22. Notices and Customer Communications
22.1. The Provider may communicate with customers electronically where permitted by law.
22.2. Customers must keep the contact information associated with their account up to date.
23. Consumer Guarantees and Statutory Rights
23.1. Mandatory statutory rights relating to the conformity and functionality of digital services remain unaffected by these Terms.
23.2. For consumers, mandatory provisions of applicable consumer protection law apply regardless of anything stated in these Terms.
24. Statutory Warranty and Conformity of the Digital Service
24.1. The Provider is responsible for ensuring that the service conforms to the contract and applicable statutory requirements.
24.2. In particular, the statutory provisions governing digital services under the Austrian Consumer Warranty Act (VGG) apply where applicable.
24.3. Where the service is defective, the consumer may exercise the statutory remedies available under applicable law.
24.4. Depending on the circumstances and applicable statutory provisions, these remedies may include bringing the digital service into conformity, price reduction or termination of the contract.
24.5. Nothing in these Terms limits or excludes mandatory statutory consumer warranty rights.
24.6. The Provider will comply with applicable statutory updating obligations for the duration required by law or the contract.
25. Amendments to These Terms
25.1. The Provider may update these Terms where this is necessary to reflect changes to the service, legal requirements or reasonable developments of the business.
25.2. Where a change requires customer consent or advance notice under applicable law, the Provider will provide the required notice or obtain the required consent.
25.3. No amendment will deprive the customer of mandatory statutory rights.
26. Governing Law and Consumer Jurisdiction (B2C)
26.1. Austrian law applies, subject to any mandatory consumer protection provisions applicable in the consumer's country of habitual residence.
26.2. The choice of Austrian law will not deprive the consumer of the protection afforded by mandatory provisions of the law that would otherwise apply to the consumer.
26.3. Any jurisdiction clause applies only to the extent permitted by mandatory consumer protection law.
27. Governing Law and Jurisdiction for Business Customers (B2B)
27.1. These Terms are governed by Austrian law, excluding its conflict-of-law rules and, to the extent legally permissible, the United Nations Convention on Contracts for the International Sale of Goods.
27.2. For contracts with entrepreneurs, the competent courts at the Provider's registered office have exclusive jurisdiction, unless mandatory law provides otherwise.
28. Severability
28.1. If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect.
28.2. The invalid provision will be replaced or interpreted in accordance with applicable mandatory law.
